Federal Judge Mandates Freedom of Abrego Garcia from ICE Detention
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without legal authority.
"Since his release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.
The case stems from a erroneous deportation to El Salvador in March, which the government later acknowledged was an error. Following his return to the United States to face human smuggling charges, he was detained in federal detention.
In her decision, the court noted that the authorities does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
Context of the Case
The legal proceedings involve conflicting claims. Whereas the former administration argues that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this claim.
He has also pleaded not guilty to the conspiracy counts, which are part of a separate trial in the state of Tennessee.
Conditions of Release
The court, who was overseeing his challenge to deportation in a federal court, ruled that he must now comply with the conditions of his bond from custody in Tennessee. This order effectively transfers his supervision to the Tennessee court.
This ruling represents a notable development in a complex immigration case featuring claims of wrongful detention and contested gang affiliations.
